The User Agreement

CAUTION: By registering to this website you agree with the following user agreement, including all of its consequences.


This is version 2 of the User Agreement. It replaces all previous versions.

TERMINOLOGY

  • The Site: this website, www.flipz.be.
  • The Organisation: JigSaw bvba, owner of the Site.
  • The Offer: the good or service that is sold to the highest bidder on this Site. There can be not any or several Offers at all times.
  • The Participant: any natural person being registered through this Site and participating in the Offer’s auction.
  • The Buyer: The Participant who at the end of the Offer’s auction has made the final bid.
  • The Description: combination of the Offer’s title and any extra information shown by clicking on the Offer.
  • The User Agreement: the present text.
  • A "flipz": the means of payment for a bid by the Participant for the Offer on this Site; each bid will cost the Participant one “flipz”, regardless of how much this “flipz” has cost him.

USER AGREEMENT

Art. 1 - Purpose

  1. The purpose of this Site is the lucrative online selling to the highest bidder of a selective number of luxury goods.

Art. 2 - Participant

  1. The Participant declares to be of full age, or to be accompanied by a major guardian during registration or every time he participates.
  2. When registering, the Participant declares to use his/her official name and address. If not, this may be considered as forgery of documents. Only the user name (nickname/pseudonym) may be freely chosen.
  3. The Participant declares to have read and understood the User Agreement and the Rules.
  4. The Participant declares to comply with the User Agreement and the Rules.
  5. Before actively participating in an auction, the Participant declares to follow at least one (1) auction passively, so that he/she exactly knows how the bidding system on this Site works.
  6. The Participant undertakes not to cause any technical problems to the Site.
  7. The Participant declares to use his/her own money to make purchases. Making bids with money belonging to other people will be considered as theft.
  8. The Participant declares to safeguard the Site and the Organisation against any and all public reproaches, gossip, destructive criticism, and any other form of harmful anti-publicity.
  9. The Participant undertakes not to make any attempt to hack the Site or to use it in any other way intended by the Organisation. If not, this will be considered as burglary.
  10. Every bid shall be binding. This means that the Participant shall be willing to actually pay every offered price. Should the Participant win the auction, he/she shall undertake to pay the winning bid as soon as possible. 


Art. 3 - Shipment & Delivery

  1. Shipment and delivery within Belgium shall be free of charge, unless otherwise stated in the Offer’s Description.
  2. For shipment to and delivery in other countries, including Holland, France and Luxembourg, the actual cost price of that shipment and delivery shall be borne by the Buyer, unless otherwise stated in the Description.
  3. Nothing shall be shipped to countries whose inhabitants cannot register on the Site as Participants.
  4. The Organisation undertakes not to make any profit on shipping and delivering the purchased Offer.
  5. Should an Offer no longer be deliverable from stock, the Organisation will propose an alternative. The Participant shall be entitled to refuse this alternative. The whole auction will then be cancelled and all “flipz” concerned will again be made available to the respective Participants.

Art. 4 - Offer & Guarantee

  1. Every Offer shall be new, and thus not second-hand, unless explicitly stated otherwise in the Offer’s Description.
  2. The guarantee shall be offered by the Organisation, as provided for by Belgian law. Any possible further guarantee may be made available through the Offer’s manufacturer.
  3. The photographs on the Site are not binding. The final Offer may vary from the depicted photograph because it only serves as an illustration. The Organisation shall not be responsible for any possible typing errors or clear substantive errors, but tries to avoid so.
  4. Only if the eventually delivered Offer clearly does not correspond to the Description, the Buyer may refuse to buy the Offer. However, this is not possible in the event of small mistakes made by the Organisation.
  5. An Offer may not be paid in cash or be exchanged for another Offer.

Art. 5 - Concept

  1. The sale on this Site is no game of chance or lottery.
  2. Registration to this Site does not include any subscription.
  3. A detailed description of the various sales procedures on the Site can be found in the Rules. These Rules are part of this User Agreement.
  4. The concept and the way of selling on this Site may be revised and/or extended at all times, without hereby requiring the Participant’s approval. This User Agreement is subject to such changes.

Art. 6 - "flipz"

  1. The purchased "flipz" may in no case be refunded.
  2. The won or earned "flipz" do not represent any monetary value.

Art. 7 - Organisation

  1. The Organisation undertakes to treat the personal and financial details from the Participant with confidentiality, and undertakes not to share them with any third parties.
  2. The Organisation undertakes not to release the Participant’s identity, unless of course a judicial authority requires the Organisation to do so.
  3. The Organisation may not be held responsible for possible technical problems with the Site. Not even when this would cause the Participant to loose money. The Organisation furthermore undertakes to make every effort to avoid such situations.
  4. The Organisation reserves the unilateral right to disqualify a Participant and/or nullify an auction if it suspects abuse or when the Participation heavily exaggerates.

Art. 8 - Restrictions

  1. The Organisation may remove from its system any offensive or misleading user name (nickname/pseudonym). The Participant concerned shall be notified hereof.
  2. It is prohibited to use several accounts at the same time (whether of not at the same address). Any Participant doing so shall be disqualified.
  3. It is prohibited to use other interfaces than those offered by the Organisation. This prohibition includes any assistance programme, any plug-in, bidding programme etc. that is not offered by the Site. Doing so shall result in disqualification.
  4. One Participant may win each offer maximum one (1) time per calendar year. Should he/she however win it again, the auction shall go the first following Participant until a Participant is found who has never won the offer before. In this case no “flipz” shall be refunded; each Participant shall be personally responsible for this.
  5. One Participant may win maximum (3) auctions within seven (7) days (= 168 hours). Should he/she however win it again, the auction shall go to the first following Participant until a Participant is found who has won during the past seven (7) days less than three (3) auctions. No “flipz” shall be refunded; each Participant shall be personally responsible for this.
